Prabin DosadCLIENT AGREEMENT & SERVICE TERMS

Important: Your accepted quotation, package details and written amendments form part of this agreement. If a signed quotation contains a different term, the most recent mutually accepted written term governs that item. Nothing here limits rights that cannot legally be limited.

1. Parties and acceptance

“Studio”, “we”, “us” and “Prabin Dosad Photography” mean the photography and cinematography service provider identified in the quotation. “Client” means the person or persons accepting the quotation. The Client confirms legal capacity to enter this agreement and authority to provide instructions for the event. Booking payment, written acceptance or signature may evidence acceptance, subject to applicable law.

2. Scope of services

Coverage dates, hours, events, crew, travel, albums, films, photographs, reels and other deliverables are only those listed in the accepted quotation or package. Anything not listed is excluded. Added services, extra events or changed requirements require written confirmation and may require revised fees and timelines.

3. Booking and reservation

A date is reserved only after the agreed booking amount has cleared and the Studio has confirmed the booking in writing. Before confirmation, the date remains available. The Studio may decline other assignments once a date is reserved.

4. Price, taxes and payment

Unless the quotation states otherwise, payment is 50% at booking, 40% on or before the first coverage day and 10% before release of final deliverables. Prices, taxes, travel and accommodation follow the quotation. Payments are received only when cleared. Late or failed payment may pause coverage, editing, album production or delivery after reasonable notice. The Client remains responsible for approved additions and applicable charges.

5. Cancellation and refunds

Cancellation is governed by the Refund Policy and the accepted quotation. Because the Studio reserves dates, assigns personnel and undertakes preparation, the booking amount is generally non-refundable after confirmation, subject to applicable law and the circumstances. Any approved refund is calculated after reasonable documented costs, completed work and non-recoverable commitments.

6. Rescheduling

The Studio will try to accommodate a written date-change request if suitable personnel are available. A transfer is not confirmed until accepted in writing. If unavailable, cancellation terms apply. New-date pricing and increased travel, accommodation, venue, permit or production costs may be charged after disclosure. Credits are non-transferable unless agreed in writing.

7. Event schedule, access and overtime

Coverage is based on agreed dates and hours. Delays caused by the Client, guests, venue, rituals, transport or third parties do not automatically extend coverage. Extra time is subject to team availability and additional charges. The Client will supply accurate schedules, addresses, contacts, permissions and restrictions promptly, and provide safe access, reasonable breaks, drinking water and meals for extended assignments where agreed.

8. Creative coverage

Photography and filmmaking are documentary and creative services. The Studio will use professional judgment and reasonable efforts to capture important people, rituals and moments, but cannot guarantee every guest, pose, expression or event. Lighting, weather, crowd movement, schedule changes, venue rules, guest devices and third-party interference may affect results. The Studio controls capture, selection, editing and artistic treatment consistent with its portfolio and agreed brief.

9. Team and substitution

The Studio may assign photographers, cinematographers, editors, assistants and vetted contractors appropriate to the assignment. If a named person becomes unavailable due to illness, emergency or circumstances outside reasonable control, the Studio may provide a suitably skilled replacement. Any material change will be communicated where practicable.

10. Deliverables, selection and delivery

Only confirmed deliverables are included. Delivery estimates begin after coverage and after the Studio receives required selections, approvals, music choices or information. High-season workload, album approval, third-party production and project complexity may affect timing. Preview content is provisional. The Client must review links and report access problems promptly.

11. Revisions and approvals

Included revisions are those stated in the quotation. Consolidated feedback must be sent within the communicated period. Delayed selections or approvals extend delivery. Major re-edits, repeated revisions, replacement selections or changes after final approval may be charged. Album printing or production begins only after final approval; approved production errors caused by client-supplied content or approval may require paid re-production.

12. File formats, storage and RAW files

RAW photographs, unedited footage, project files, timelines, source files and internal working materials are excluded unless expressly agreed. The Studio may remove online galleries and working files after the retention period communicated for the project. The Client should download, verify and maintain backups after delivery. Long-term archival is not guaranteed.

13. Copyright and client licence

Unless copyright is expressly transferred in writing, the Studio retains copyright and ownership of original creative works and working files. On full payment, the Client receives a non-exclusive, non-transferable licence to use delivered media for personal, family and non-commercial purposes, including personal social media. Commercial advertising, resale, publication by vendors or third-party commercial use requires prior written permission and may require a licence. The Client should not apply misleading edits or remove credits where credit was agreed.

14. Portfolio consent and privacy requests

Where the Client has consented in the quotation or otherwise in writing, the Studio may use selected work for its website, portfolio, social media, awards, exhibitions and promotion. The Client may request a private-use arrangement before the event. The Studio will record agreed restrictions. Withdrawal cannot always undo lawful publication or third-party sharing already completed, but the Studio will address future controlled use as required by applicable law and the agreement.

15. Guests, minors and sensitive moments

The Client will inform the Studio in advance of private areas, people who must not be photographed, restrictions concerning children, religious requirements and sensitive rituals. The Client is responsible for communicating event photography arrangements to guests where appropriate. The Studio will use reasonable efforts to respect advance instructions but cannot control guest uploads or independent third parties.

16. Travel and accommodation

Outstation travel, accommodation, local transport, baggage, permits, location fees and related costs are borne by the Client unless expressly included. Bookings and safety arrangements must meet agreed requirements. Material itinerary changes may change costs.

17. Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disaster, severe weather, government action, epidemic restrictions, civil disturbance, venue closure, serious accident or major transport disruption. The parties will first consider practical rescheduling, substitution or partial performance. Financial adjustment will reflect recoverable amounts, work completed and unavoidable costs, subject to applicable law.

18. Equipment, data and technical risk

The Studio uses professional equipment and reasonable backup practices, but technical failure, corruption, theft or loss can occur. If material content is lost despite reasonable care, remedies will be assessed for the affected service, including re-performance where possible or a proportionate refund. Liability is not excluded where applicable law does not allow exclusion.

19. Third-party interference

The Studio is not responsible for missed or compromised content caused by venue staff, planners, decorators, guests, other photo/video teams, security restrictions, poor lighting, blocked access or instructions outside the Studio’s control. The Client should coordinate vendors so the Studio can perform safely and without unreasonable obstruction.

20. Conduct and safety

Threats, harassment, discrimination, abuse, unsafe conditions or deliberate obstruction may cause the Studio to pause or end services after warning where circumstances permit. Immediate withdrawal may be necessary for serious safety risks. Charges and remedies will be assessed fairly in light of responsibility, work completed and applicable law.

21. Client-supplied materials

The Client confirms that any music, logos, photographs, instructions or other material supplied for inclusion may lawfully be used. The Studio may refuse material that appears unlawful or infringing. Platform music restrictions and takedowns outside the Studio’s control are not guaranteed against.

22. Complaints and corrections

Concerns should be sent to prabindosadphotography@gmail.com within 7 days after the relevant delivery, with specific examples. The Studio will review them in good faith. A technical defect will be corrected where reasonably possible. A difference in subjective creative preference is not itself a defect where work substantially follows the agreed scope and style.

23. Liability

To the maximum extent permitted by law, neither party is liable for indirect, special or speculative loss. The Studio’s aggregate liability relating to an affected service will not exceed the amount paid for that affected service, except where such limitation is prohibited. Nothing excludes liability for fraud, wilful misconduct or any liability that cannot lawfully be limited.

24. Privacy and communications

Personal data is handled under the Privacy Policy. The Client agrees that operational communications may be sent by phone, email or WhatsApp using supplied details. Marketing messages require the appropriate permission and may be opted out of.

25. General terms

The quotation, package, these terms and mutually accepted written changes form the agreement. A failure to enforce a term is not a waiver. If one term is unenforceable, the remaining terms continue to the extent lawful. Neither party may assign material obligations without consent, except the Studio may use personnel and contractors as described above. Headings are for convenience. Electronic records and signatures may be used where legally valid.

26. Governing law and disputes

Indian law governs this agreement. The parties will first attempt good-faith resolution. Subject to non-waivable consumer rights and the jurisdiction of consumer commissions or other competent authorities, courts with appropriate jurisdiction in Kolkata, West Bengal will have jurisdiction.

Booking confirmation

By signing, the parties confirm that they have read and accepted the quotation, service scope, payment schedule, these Terms and the linked Refund and Privacy Policies.
